(hereinafter "Provider" or "we")

1. Scope and Subject Matter

These Terms and Conditions govern the use of the mobile application "Red Thread" ("App") and all related services provided by the Provider to users ("User" or "you"). The subject matter of the contract is to make the App available for use on mobile devices. The App grants access to a library of guided audio tours and enables users to create personalised tours. Deviating or additional user terms do not apply unless we have expressly agreed to them in writing.

2. Services and Functionality

Free and paid use: The App can be used in a free basic version with limited functionality. Advanced features, higher usage quotas or additional content are paid and can be unlocked via in-app purchases (e.g. subscriptions or one-off purchases).

Service description: The exact and current scope of services, features and any limitations of both the basic version and paid services are described within the App and on the product pages of the app stores (Apple App Store, Google Play Store).

Custom tour creation: A core function of the App is to create individual tours based on the user's wishes (location and topic). Availability and quotas depend on the chosen usage model.

An active internet connection is required. Certain paid services may include an offline mode that allows previously downloaded content to be used without an internet connection.

3. Special Notice: Use of Generative AI (GenAI)

Transparency: You acknowledge and agree that tour content, in particular individually created tours, may be produced in whole or in part using generative artificial intelligence (GenAI).

Accuracy notice: Despite due care, AI-generated content can contain inaccuracies, errors or outdated information.

Personal responsibility: You should verify critical information independently (e.g. opening hours, admission prices, safety warnings, terrain conditions).

Liability: We are only liable for AI-generated content within the framework of statutory provisions; we do not provide any additional warranty for accuracy or completeness.

4. Conclusion of Contract, Term and Termination

The basic usage contract is formed by downloading the App and agreeing to these Terms. A paid contract is concluded exclusively through the respective app store (in-app purchase). The conditions of the respective app store operator (Apple or Google) also apply.

Term and renewal: The term and renewal conditions of any paid service (e.g. subscription) are displayed in the app store prior to purchase.

Termination: A paid service must be cancelled through the account settings of the respective app store. Cancellation directly within the App or via e-mail to us is not possible.

5. User Obligations

You are responsible for keeping your access credentials confidential.

You agree not to misuse the App, in particular not to create or distribute unlawful, offensive or harmful content.

Safety: During any tour, you alone are responsible for your safety (e.g. compliance with traffic rules, risk assessment, respect for private property).

5a. Rights to Tours Created (New Clause)

Grant of rights: By creating and saving an individual tour via the App, you grant the Provider a simple, non-exclusive, worldwide and unrestricted licence in terms of time and content to use the content you create (in particular the tour description, route, waypoints and all related texts and metadata).

Purpose of the licence: This licence entitles the Provider, in particular, to make the tours you create available to other users of the App (to publish them) and, for this purpose, to store, reproduce, edit (e.g. for technical adjustments, optimisation or editorial revision), make them publicly accessible and distribute them.

No remuneration: You do not receive any separate remuneration for granting these rights of use.

6. Prices and Payment Terms

The basic version is free of charge.

For paid services, the prices displayed at the time of purchase in the app store (including statutory VAT) apply.

Billing is handled via the payment method stored with the respective app-store operator.

7. Right of Withdrawal for Consumers

Note: Paid services are concluded exclusively via the app stores (Apple, Google). Any withdrawal must be exercised there.

Withdrawal policy

Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The period begins upon conclusion of the contract.

To exercise the right of withdrawal, you must inform the respective app-store operator. A declaration made directly to us (Voltaire Vision UG) is not sufficient.

Consequences of withdrawal: In the event of withdrawal, the respective app-store operator refunds all payments.

Expiry of the right of withdrawal: The right of withdrawal expires once digital content has been delivered after you have expressly consented to performance beginning before the expiry of the withdrawal period and acknowledged that you thereby lose your right of withdrawal.

8. Liability

We are fully liable in cases of intent and gross negligence.

In the event of slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage.

Otherwise, liability for slight negligence is excluded.

The above liability limitations do not apply in cases of injury to life, body or health, nor in cases of mandatory liability under the German Product Liability Act.

9. Data Protection

Information on the processing of personal data can be found in our separate privacy policy, available within the App and on our website.

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection regulations of the country in which the consumer has their habitual residence remain unaffected.

The European Commission provides a platform for Online Dispute Resolution (ODR): http://ec.europa.eu/consumers/odr/ .

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

If individual provisions of these Terms are or become invalid, the validity of the remaining provisions shall remain unaffected.
